Agreement to These Terms
These Terms of Service govern your access to and use of Ember Tables, including our website, game-creation tools, gameplay features, publishing flows, legal policy pages, paid Founder Lifetime Membership offer, and related services.
By accessing or using the Service, creating an account, publishing a game, joining a match, buying a Founder Lifetime Membership, or clicking to accept a policy, you agree to these Terms and the Policies incorporated into them.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and references to “you” include that organization where appropriate.
Other Policies; Incorporated Terms
The Privacy Policy, Copyright and DMCA Policy, Published Game Configuration Terms, Community and Commercial Events Policy, and Founder Lifetime Membership Terms are incorporated into these Terms.
Some features require additional acceptance. Publishing a game requires acceptance of the current Published Game Configuration Terms before publication under that version. Buying a Founder Lifetime Membership requires acceptance of the Founder Lifetime Membership Terms and any checkout terms presented before purchase.
If we later offer additional paid features, marketplace features, official APIs, event tooling, subscriptions, creator programs, or other commercial programs, those features may be subject to separate or additional terms before use.
Eligibility
The Service is intended for users who are at least 13 years old. Users under 13 may not use the Service.
If you are under the age of majority where you live, you may use the Service only with permission from your parent or legal guardian.
Publishing a game is an adult-only feature. You may publish only if you are at least 18 years old and able to form a binding agreement.
Paid purchases require legal authorization. For Founder Lifetime Membership purchases, the purchaser must be at least 18 years old and legally authorized to complete the purchase, or must be the parent or legal guardian completing the purchase for the Ember Tables account user.
Accounts and Security
You are responsible for your account credentials and for activity under your account.
You may not sell, buy, rent, lease, transfer, share, sublicense, broker, or otherwise provide access to an account except through features Ember Tables expressly provides. You may not misrepresent your identity or affiliation, interfere with another account, or attempt to bypass authentication, eligibility, policy-acceptance, purchase, security, or integrity controls.
Account-linked entitlements, including Founder Lifetime Membership and Founder Numbers, belong to the account record and may not be privately transferred, resold, gifted, traded, brokered, or moved between accounts unless Ember Tables expressly approves an exception in writing.
We may store policy-acceptance records, including policy slug, version, content hash or equivalent record identifier, acceptance timestamp, and acceptance context, to document which terms governed a feature, purchase, or action.
Your Content; Games and Configurations
You may use Ember Tables tools to create drafts, configurations, preferences, and other material within the Service.
You are responsible for material you provide or cause to be submitted through the Service, and you represent that you have the rights and permissions needed for that material.
Drafts, unpublished configurations, local preferences, and other account-associated material remain subject to these Terms and may be stored, processed, moderated, deleted, or restricted as needed to operate the Service.
License You Grant for Unpublished Content
For content or configuration material that you submit to the Service before publication, you grant Ember Tables a worldwide, nonexclusive, royalty-free license to host, store, reproduce, process, display, test, debug, secure, moderate, back up, and otherwise use that material as needed to provide, maintain, protect, and improve the Service.
This pre-publication license does not by itself give other users a general right to fork or republish your unpublished drafts.
Published Games and Community Use
Published game configurations are governed by the Published Game Configuration Terms. They are intended to be durable public platform objects used for play, discovery, forking, remixing, analysis, moderation, recommendation, and related platform functions.
After you publish a game, you do not have a user-side right to delete, unpublish, reclaim, withdraw, approve, veto, manage, or block ordinary downstream platform use of that published configuration.
Other users and permitted ecosystem participants may play, discuss, stream, analyze, fork, modify, remix, rename, rebalance, and republish published game configurations under platform rules and applicable policies.
Ember Tables may remove, delist, restrict, disable, rename, rebalance, feature, commercialize, or otherwise manage published game configurations for legal, safety, integrity, operational, product, or business reasons.
Community and Commercial Events
Third parties may organize community events, tournaments, leagues, streams, brackets, competitions, or similar activities involving Ember Tables games, subject to these Terms and the Community and Commercial Events Policy.
This permission does not mean Ember Tables currently provides first-party tournament tooling. Ember Tables does not currently provide event calendars, brackets, registration systems, organizer dashboards, event payment processing, prize administration, tax reporting, sponsor reporting, or official event tooling unless a separate feature or written agreement says otherwise.
Unless Ember Tables expressly agrees in writing, third-party events are independent from Ember Tables and may not be presented as official, endorsed, sponsored, administered, or operated by Ember Tables.
Founder Lifetime Membership
Ember Tables may offer a one-time Founder Lifetime Membership for a limited number of founder accounts. The Founder Lifetime Membership is governed by the Founder Lifetime Membership Terms.
Founder Lifetime Membership is an account-bound digital entitlement and access right, not ownership of separate digital property, stored value, a financial account, a security, an investment, or a transferable asset.
“Lifetime” has the meaning given in the Founder Lifetime Membership Terms. It means the lifetime of the Ember Tables player-facing service for the purchasing account while that account remains active and in good standing, not the biological lifetime of a person or a promise that Ember Tables will operate indefinitely.
Founder Lifetime Membership purchases are one-time purchases, not subscriptions, and do not create recurring charges. Refunds, chargebacks, reversals, fraud, invalid purchases, or payment abuse may result in revocation, disablement, withholding, or review of the entitlement and Founder Number.
Payments, Stripe, Refunds, and Commercial Activity
Ember Tables uses Stripe-hosted Checkout for Founder Lifetime Membership payments. Stripe processes payment details. Ember Tables does not directly store full card numbers, but may store Stripe customer IDs, checkout session IDs, payment intent IDs, webhook event IDs or payloads, order records, entitlement records, user ID snapshots, email snapshots, refund and dispute records, and related support or fraud-review records.
The Founder Lifetime Membership refund period is described in the Founder Lifetime Membership Terms. Unless those terms or applicable law say otherwise, purchases are final after the stated refund period.
Other than the limited Founder Lifetime Membership offer, Ember Tables does not currently sell paid cosmetics, recurring subscriptions, paid event tools, creator marketplace items, paid API/data products, creator payout products, prize/tax services, or first-party event payment products unless a separate feature, checkout, or written agreement says otherwise.
If Ember Tables later offers paid features or requires fees for a commercial program, the applicable payment, refund, tax, renewal, cancellation, and platform-fee terms will be provided before the paid feature is enabled.
Prizes, Fees, and Event Monetization
Prize pools and player winnings are not treated as Ember Tables platform-fee revenue merely because they are large. Commercial monetization is the fee target, such as organizer-retained entry fees, ticket sales, sponsorships, advertising, paid broadcasts, premium access, paid cosmetics, subscriptions, paid tools, official API/data products, marketplace sales, or similar value retained by an organizer or commercial participant.
Prize pools, winnings, donations, crowdfunding, merchandise, entry fees, sponsorships, and similar arrangements may still create tax, consumer-protection, gambling, lottery, minors, payment, fraud, or reporting obligations for organizers or participants.
Founder Lifetime Membership revenue is first-party Ember Tables account/platform revenue. It does not create compensation, royalties, revenue share, prize funding, creator payout, or publisher compensation for users who publish game configurations.
Cosmetics, Virtual Items, and Future Marketplace Features
Ember Tables may display or support cosmetic settings, avatars, themes, visual effects, Founder Numbers, badges, profile recognition, or similar virtual items. Unless separate terms say otherwise, virtual items and digital benefits are licensed account/platform features, not cash, deposits, stored value, property interests, or transferable assets.
Ember Tables does not currently operate a paid cosmetics marketplace, public creator-asset marketplace, creator payout program, resale market, or revenue-share program unless a separate feature, checkout, or written agreement says otherwise.
Published game configurations are separate from cosmetics, artwork, audio, fonts, marketplace assets, and other expressive assets. Future creator-asset programs may use separate ownership, license, monetization, removal, and payout terms.
Public Information, Data, APIs, and Automation
Public pages, published game configurations, match information, replay-like records, rankings, recommendations, metadata, and other public or user-visible surfaces may be viewed, discussed, streamed, indexed by the Service, and used for ordinary personal or community activity subject to these Terms.
You may not scrape, crawl, bulk harvest, reverse engineer, overload, bypass rate limits, evade access controls, or use automated access in a way that harms the Service, replicates core platform functionality, or exceeds permissions we provide.
Ember Tables does not currently offer an official paid API/data product, developer portal, bulk export product, sponsor-reporting feed, or commercial analytics license unless a separate feature or written agreement says otherwise. We may offer API, data, developer, or integration terms in the future.
Sponsorships, Advertising, Streaming, Media, and Brand Use
You may stream, record, comment on, review, discuss, teach, compare, or create media about public Ember Tables games, subject to these Terms, platform rules, and rights of others.
If your content, event, broadcast, team, tool, or promotion has a paid sponsorship, endorsement, affiliate relationship, free product, revenue share, or other material connection, you are responsible for disclosing that connection clearly and complying with applicable advertising, endorsement, platform, and consumer-protection rules.
You may not imply that Ember Tables sponsors, endorses, operates, approves, or is affiliated with your event, tool, team, broadcast, sponsor, product, or promotion unless Ember Tables expressly agrees in writing.
Founder Lifetime Membership ad-free benefits apply only as described in the Founder Lifetime Membership Terms and do not prevent service notices, safety notices, transactional messages, sponsorship disclosures, marketplace listings, or third-party/user-controlled content where those are not third-party display ads shown by Ember Tables in the player-facing service.
Acceptable Use
You may not use the Service to violate law, infringe rights, harass others, impersonate others, spam, defraud, manipulate payments, abuse refunds or chargebacks, evade sanctions, attack the Service, bypass security controls, interfere with gameplay, exploit bugs, scrape at scale, or otherwise harm users, Ember Tables, or the integrity of the Service.
You may not submit malicious, deceptive, infringing, privacy-violating, exploitative, illegal, or unsafe material, or use the Service to distribute malware, credential-harvesting, phishing, scams, or unauthorized automation.
You may not attempt to sell, broker, transfer, trade, or resell accounts, Founder Memberships, Founder Numbers, digital entitlements, virtual items, event permissions, or other platform access except through official features Ember Tables expressly provides.
Moderation and Enforcement
Ember Tables may investigate suspected violations and may remove content, delist or restrict games, disable features, cancel or revoke entitlements, withhold or reverse benefits, restrict accounts, suspend accounts, terminate accounts, block access, preserve records, or take other action it reasonably deems appropriate.
We may act without prior notice where needed for safety, legal compliance, security, fraud prevention, payment integrity, copyright enforcement, platform integrity, or protection of users or Ember Tables.
Enforcement decisions may be manual, automated, or a combination, and may consider account history, payment history, technical signals, user reports, legal notices, product integrity, and other relevant information.
Account Closure, Deletion, and Survival
Account closure, deletion, suspension, termination, or loss of access does not automatically undo published-game rights, policy acceptance records, payment records, order records, entitlement records, enforcement records, DMCA records, fraud records, accounting records, or other records that Ember Tables needs to retain for legal, security, integrity, support, accounting, dispute, or operational reasons.
If you delete your account, some account-associated features and benefits may become unavailable. Founder Lifetime Membership recovery may require support verification and is not guaranteed unless Ember Tables can verify the entitlement and restore access under applicable policies.
Deleting an account does not require Ember Tables to return a Founder Number to available inventory.
Disclaimers
The Service is provided on an “as is” and “as available” basis to the maximum extent permitted by law.
Ember Tables does not promise that the Service, games, matches, publishing, recommendations, cosmetics, Founder Membership benefits, events, or other features will be uninterrupted, error-free, secure, available in every region, compatible with every device, or free from changes, delays, bugs, loss, downtime, or data issues.
Founder Lifetime Membership is an early supporter offer. It does not create a service-level agreement, uptime guarantee, roadmap guarantee, investment expectation, ownership interest, or promise that Ember Tables will operate indefinitely.
Limitation of Liability
To the maximum extent permitted by law, Ember Tables and its owners, operators, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, business interruption, or similar losses arising from or related to the Service.
To the maximum extent permitted by law, Ember Tables’ total liability for claims arising from or related to the Service will not exceed the greater of $100 or the amount you paid Ember Tables for the Service in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
Indemnity
You agree to defend, indemnify, and hold harmless Ember Tables and its owners, operators, service providers, and affiliates from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to your use of the Service, your content, your published games, your events, your commercial activity, your sponsorships, your payments or chargebacks, your violation of these Terms or incorporated Policies, or your violation of law or third-party rights.
Ember Tables may control the defense of any matter subject to indemnity, and you agree to cooperate with that defense.
Changes to the Service or Terms
Ember Tables may change, suspend, discontinue, rename, redesign, replace, or limit the Service or any feature, including game features, publishing features, cosmetic features, event permissions, paid features, or Founder Membership benefit surfaces, subject to any specific rights stated in applicable additional terms.
We may update these Terms and incorporated Policies from time to time. If we make material changes, we may provide additional notice or request renewed acceptance where required or appropriate.
The current version and effective date are shown on the legal policy page.
Assignment and Business Transfers
You may not assign or transfer your rights or obligations under these Terms without Ember Tables’ prior written approval.
Ember Tables may assign or transfer these Terms, incorporated Policies, accounts, published-game records, policy acceptance records, payment/order/entitlement records, Founder Membership records, and other Service-related rights and obligations to an entity formed to operate Ember Tables or in connection with a merger, acquisition, financing, reorganization, sale of assets, change of control, or successor operation of the Service, subject to applicable law.
A successor that continues the Ember Tables player-facing service may continue Founder Lifetime Membership benefits according to the Founder Lifetime Membership Terms.
Governing Law and Venue
These Terms are governed by the laws of California and the United States, without regard to conflict-of-law rules, except where applicable consumer law requires otherwise.
Subject to any non-waivable rights you may have, disputes relating to these Terms or the Service will be brought in the state or federal courts located in California, and you consent to personal jurisdiction and venue there.
