Agreement to These Terms

These Terms of Service (the “Terms”) are an agreement between you and Ember Tables (“Ember Tables,” “we,” “us,” or “our”) governing your access to and use of the Ember Tables website, applications, and related services (collectively, the “Service”).

By clicking “I agree,” creating an account, publishing a game, claiming cosmetics, or otherwise accessing or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

Other Policies; Incorporated Terms

These Terms incorporate by reference our Privacy Policy and any additional policies, terms, or notices we publish at `/legal` (collectively, “Policies”).

Some actions require acceptance of specific Policies (for example, publishing a game or claiming cosmetics). When required, we will prompt you to accept the current versions before you can complete that action.

Eligibility (13+)

You must be at least 13 years old to use the Service. The Service is not directed to children under 13, and you may not use the Service if you are under 13.

If you are not the age of majority where you live, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your use of the Service.

You represent and warrant that you meet these eligibility requirements.

Accounts and Security

Some features may require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Accounts are personal to the registered user and are non-transferable. You may not sell, buy, rent, lease, transfer, share, or otherwise provide access to your account or login credentials to any other person or entity.

We do not recognize purported account transfers, sales, or purchases conducted through third-party marketplaces, brokers, or private arrangements.

You agree to provide accurate information, keep it up to date, and promptly notify us of any suspected unauthorized access or security issue related to your account.

We may suspend or disable accounts that we reasonably believe are compromised or used in violation of these Terms.

Your Content; Games and Configurations

The Service allows you to create, modify, fork, and publish game configurations and related data (collectively, “User Content”). “User Content” does not include Ember Tables’ software, the engine, site design, or other content we provide.

You are responsible for your User Content and for ensuring you have all rights necessary to submit it and authorize any licenses or transfers described in these Terms and applicable Policies.

Publishing a game may require you to accept additional terms (for example, a published-game rights transfer or license policy). Those terms govern what happens to published game artifacts.

Features like favorites, recents, and playlists (if available) are personal shortcuts and do not imply ownership or control rights over any game.

License You Grant to Ember Tables (Unpublished Content)

To operate the Service, you grant Ember Tables a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt (for technical purposes), and display your User Content as necessary to provide, secure, and improve the Service.

This license is limited to operating the Service and does not, by itself, change ownership of your User Content. Additional rights may apply if you publish a game under a separate published-game policy.

Acceptable Use

You may not use the Service to break the law, violate others’ rights, or engage in harmful, abusive, deceptive, or fraudulent activity.

You may not (a) probe, scan, or test the vulnerability of the Service; (b) bypass or attempt to bypass security or rate limits; (c) interfere with or disrupt the Service; (d) scrape the Service at scale without our written permission; or (e) upload malware or exploit code.

You may not upload or publish User Content that infringes intellectual property rights, misappropriates trade secrets, or violates privacy or publicity rights.

Enforcement; Suspension; Termination

We may investigate suspected violations and take actions we deem appropriate, including removing content, restricting features, suspending accounts, or terminating access to the Service.

We may terminate or suspend your access at any time if we reasonably believe you violated these Terms or applicable Policies, or if we must do so to comply with law or protect the Service.

Upon termination, your right to use the Service stops. Sections that by their nature should survive termination will survive (including licenses, disclaimers, limitation of liability, dispute resolution, and indemnity).

Cosmetics, Virtual Items, and Purchases

The Service may offer cosmetics, virtual items, or other digital goods (“Virtual Items”). Virtual Items are licensed, not sold, and may be governed by additional Policies (for example, cosmetics license terms).

Virtual Items are non-transferable and may not be resold, gifted, sublicensed, or transferred through third-party marketplaces unless we explicitly offer a feature that permits it.

If your account is suspended or terminated, or if required by law or policy enforcement, we may revoke or disable access to Virtual Items.

We may add, modify, or remove Virtual Items and related features at any time. Availability may vary by game, mode, or region.

Third-Party Services and Links

The Service may integrate or link to third-party services. We do not control third-party services and are not responsible for them.

Your use of third-party services is governed by their own terms and privacy policies.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMBER TABLES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any game, configuration, or feature will function exactly as expected in all cases.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMBER TABLES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMBER TABLES’ TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU PAID TO EMBER TABLES FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations. In those jurisdictions, liability will be limited to the maximum extent permitted by law.

Indemnity

You agree to defend, indemnify, and hold harmless Ember Tables and its operators, affiliates, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service, (b) your User Content, or (c) your violation of these Terms or applicable Policies.

Governing Law; Venue

These Terms are governed by the laws of the State of California, excluding its conflict of law principles.

Except where prohibited by law, you agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in California, and you consent to personal jurisdiction and venue in those courts.

Changes to the Service or Terms

We may change the Service or these Terms from time to time. If we make material changes, we may require you to re-accept the updated Terms or relevant Policies before continuing to use certain features.

The version and effective date of these Terms are shown on the legal page for this version.

Assignment; Successor Operator

You may not assign these Terms without our prior written consent. We may assign these Terms, including to an entity formed to operate Ember Tables, including in connection with a merger, acquisition, reorganization, or sale of assets.

If we assign these Terms, the assignee will assume our rights and obligations under these Terms.

You agree that we may provide notices to you electronically, including by email, in-product notice, or posting to the Service. You are responsible for keeping your contact information current.

Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision is not a waiver of our right to do so later.

These Terms, together with the incorporated Policies, are the entire agreement between you and Ember Tables regarding the Service and supersede prior agreements on that subject.
