Agreement to These Terms
These Terms of Service govern your access to and use of Ember Tables, including our website, game-creation tools, gameplay features, publishing flows, legal policy pages, and related services.
By accessing or using the Service, creating an account, publishing a game, joining a match, or clicking to accept a policy, you agree to these Terms and the Policies incorporated into them.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and references to “you” include that organization where appropriate.
Other Policies; Incorporated Terms
The Privacy Policy, Copyright and DMCA Policy, Published Game Configuration Terms, and Community and Commercial Events Policy are incorporated into these Terms.
Some features require additional acceptance. Publishing a game requires acceptance of the current Published Game Configuration Terms before publication under that version.
If we later offer paid features, marketplace features, official APIs, event tooling, subscriptions, creator programs, or other commercial programs, those features may be subject to separate or additional terms before use.
Eligibility
The Service is intended for users who are at least 13 years old. Users under 13 may not use the Service.
Publishing a game is an adult-only feature. You may publish only if you are at least 18 years old and able to form a binding agreement.
You are responsible for complying with laws that apply to your use of the Service, including laws that apply to your location, account, communications, content, events, and commercial activity.
Accounts and Security
You are responsible for your account credentials and for activity under your account.
You may not share accounts, misrepresent your identity or affiliation, interfere with another account, or attempt to bypass authentication, eligibility, policy-acceptance, security, or integrity controls.
We may store policy-acceptance records, including policy slug, version, content hash or equivalent record identifier, acceptance timestamp, and acceptance context, to document which terms governed a feature or action.
Your Content; Games and Configurations
You may use Ember Tables tools to create drafts, configurations, preferences, and other material within the Service.
You are responsible for material you provide or cause to be submitted through the Service, and you represent that you have the rights and permissions needed for that material.
Drafts, unpublished configurations, local preferences, and other account-associated material remain subject to these Terms and may be stored, processed, moderated, deleted, or restricted as needed to operate the Service.
License You Grant for Unpublished Content
For content or configuration material that you submit to the Service before publication, you grant Ember Tables a worldwide, nonexclusive, royalty-free license to host, store, reproduce, process, display, test, debug, secure, moderate, back up, and otherwise use that material as needed to provide, maintain, protect, and improve the Service.
This pre-publication license does not by itself give other users a general right to fork or republish your unpublished drafts.
Published Games and Community Use
Published game configurations are governed by the Published Game Configuration Terms. They are intended to be durable public platform objects used for play, discovery, forking, remixing, analysis, moderation, recommendation, and related platform functions.
After you publish a game, you do not have a user-side right to delete, unpublish, reclaim, withdraw, approve, veto, manage, or block ordinary downstream platform use of that published configuration.
Other users and permitted ecosystem participants may play, discuss, stream, analyze, fork, modify, remix, rename, rebalance, and republish published game configurations under platform rules and applicable policies.
Ember Tables may remove, delist, restrict, disable, rename, rebalance, feature, commercialize, or otherwise manage published game configurations for legal, safety, integrity, operational, product, or business reasons.
Community and Commercial Events
Third parties may organize community events, tournaments, leagues, streams, brackets, competitions, or similar activities involving Ember Tables games, subject to these Terms and the Community and Commercial Events Policy.
This permission does not mean Ember Tables currently provides first-party tournament tooling. At MVP launch, Ember Tables does not provide event calendars, brackets, registration systems, organizer dashboards, event payment processing, prize administration, tax reporting, sponsor reporting, or official event tooling.
Unless Ember Tables expressly agrees in writing, third-party events are independent from Ember Tables and may not be presented as official, endorsed, sponsored, administered, or operated by Ember Tables.
Payments, Fees, Prizes, and Commercial Activity
At MVP launch, Ember Tables does not sell paid cosmetics, subscriptions, paid event tools, creator marketplace items, paid API/data products, or other paid platform products, and does not process creator payouts, prize payments, event entry fees, or platform checkout flows.
If Ember Tables later offers paid features or requires fees for a commercial program, the applicable payment, refund, tax, renewal, cancellation, and platform-fee terms will be provided before the paid feature is enabled.
Prize pools and player winnings are not treated as Ember Tables platform-fee revenue merely because they are large. Commercial monetization is the fee target, such as organizer-retained entry fees, ticket sales, sponsorships, advertising, paid broadcasts, premium access, paid cosmetics, subscriptions, paid tools, official API/data products, marketplace sales, or similar value retained by an organizer or commercial participant.
Prize pools, winnings, donations, crowdfunding, merchandise, entry fees, sponsorships, and similar arrangements may still create tax, consumer-protection, gambling, lottery, minors, payment, fraud, or reporting obligations for organizers or participants.
Cosmetics, Virtual Items, and Future Marketplace Features
Ember Tables may display or support cosmetic settings, avatars, themes, visual effects, or similar virtual items. Unless separate terms say otherwise, virtual items are licensed digital features, not cash, deposits, stored value, property interests, or transferable assets.
At MVP launch, Ember Tables does not operate a paid cosmetics marketplace, public creator-asset marketplace, creator payout program, resale market, or revenue-share program.
Published game configurations are separate from cosmetics, artwork, audio, fonts, marketplace assets, and other expressive assets. Future creator-asset programs may use separate ownership, license, monetization, removal, and payout terms.
Public Information, Data, APIs, and Automation
Public pages, published game configurations, match information, replay-like records, rankings, recommendations, metadata, and other public or user-visible surfaces may be viewed, discussed, streamed, indexed by the Service, and used for ordinary personal or community activity subject to these Terms.
You may not scrape, crawl, bulk harvest, reverse engineer, overload, bypass rate limits, evade access controls, or use automated access in a way that harms the Service, replicates core platform functionality, or exceeds permissions we provide.
At MVP launch, Ember Tables does not offer an official paid API/data product, developer portal, bulk export product, sponsor-reporting feed, or commercial analytics license. We may offer API, data, developer, or integration terms in the future.
Sponsorships, Advertising, Streaming, Media, and Brand Use
You may stream, record, comment on, review, discuss, teach, compare, or create media about public Ember Tables games, subject to these Terms, platform rules, and rights of others.
If your content, event, broadcast, team, tool, or promotion has a paid sponsorship, endorsement, affiliate relationship, gifted consideration, or other material connection that viewers would not reasonably expect, you are responsible for making clear and conspicuous disclosures where required by law.
You may not use Ember Tables names, logos, branding, trade dress, or confusingly similar marks in a way that falsely suggests official status, endorsement, sponsorship, partnership, or control.
Acceptable Use
You may not use the Service to violate law, infringe rights, harass or threaten others, distribute malware, exploit minors, manipulate matches or rankings, commit fraud, evade enforcement, interfere with the Service, or access systems or data without authorization.
You may not publish or submit material that infringes intellectual property rights, violates privacy or publicity rights, contains unlawful content, impersonates others, or is designed to exploit, attack, or disrupt the Service.
You may not use bugs, bots, automation, collusion, multi-accounting, or other unfair methods to manipulate gameplay, publishing, discovery, rankings, events, prizes, cosmetics, payments, or platform systems.
Enforcement; Suspension; Termination
We may investigate suspected violations and take actions we reasonably deem appropriate, including warnings, content removal, delisting, feature restrictions, match or event restrictions, account suspension, account termination, technical blocks, or legal process.
We may act without prior notice where needed to protect users, the Service, legal compliance, security, integrity, or third-party rights.
Account deletion, suspension, or termination does not require Ember Tables to remove published game configurations that were published under the Published Game Configuration Terms, though we may remove or restrict material for legal, safety, integrity, or operational reasons.
Third-Party Services and Links
The Service may rely on third-party infrastructure, authentication, hosting, analytics, security, communications, or other service providers.
Third-party websites, tools, streams, communities, organizers, sponsors, and integrations are not controlled by Ember Tables unless we expressly say otherwise, and their separate terms and policies may apply.
Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Ember Tables disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, and uninterrupted or error-free operation.
We do not guarantee that any game, match, ranking, recommendation, event, public page, policy, or feature will remain available, unchanged, compatible, or free from errors.
Limitation of Liability
To the fullest extent permitted by law, Ember Tables will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, goodwill, reputation, business, revenue, or opportunity.
To the fullest extent permitted by law, Ember Tables' total liability for all claims relating to the Service will not exceed the greater of the amount you paid Ember Tables for the Service in the six months before the claim or one hundred U.S. dollars.
Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
Indemnity
You agree to defend, indemnify, and hold harmless Ember Tables and its operators, contractors, service providers, and representatives from claims, damages, liabilities, losses, costs, and expenses arising from your use of the Service, your content, your events, your commercial activity, your violation of these Terms or Policies, or your violation of law or third-party rights.
Ember Tables may control the defense of any matter subject to indemnification, and you agree to cooperate with our defense.
Governing Law; Venue
These Terms are governed by the laws of California and applicable U.S. federal law, without regard to conflict-of-law rules.
Subject to any non-waivable consumer rights, disputes relating to these Terms or the Service will be resolved in the state or federal courts located in California, and you consent to personal jurisdiction and venue there.
Changes to the Service or Terms
We may update the Service and these Terms over time. If we make material changes, we may provide additional notice or require renewed acceptance where appropriate or required.
Future paid features, marketplace features, official API/data products, event tooling, creator programs, subscriptions, or commercial licenses may require separate terms before use.
Assignment; Successor Operator
You may not assign these Terms without our prior written consent.
Ember Tables may assign these Terms, the Policies, and related rights and obligations as part of a merger, acquisition, financing, reorganization, sale of assets, change of control, or transfer to a successor operator.

Legal notices must be sent through the contact method specified in the applicable Policy or other notice instructions we provide.
Miscellaneous
These Terms and incorporated Policies are the entire agreement between you and Ember Tables regarding the Service, except for feature-specific terms you separately accept.
If part of these Terms is unenforceable, the remaining parts remain in effect. Our failure to enforce a provision is not a waiver. Headings are for convenience only.
